Documents Required for Trademark Registration
To initiate the trademark registration process, the following documents are needed:
- For Individuals & Sole Proprietors:
- Identity proof (PAN, Aadhaar, Passport, etc.)
- Address proof
- Logo or wordmark in JPEG format (if applicable)
- Signed Form TM-48 (Power of Attorney)
- For Partnership/LLP/Company:
- Certificate of Incorporation or Partnership Deed
- Company PAN Card
- Address proof of business
- Logo in JPEG format
- Signed TM-48 (Power of Attorney)
- Board Resolution (if applicable)
Trademark Registration Process
- Trademark Search: Check for existing trademarks to ensure uniqueness and avoid potential conflicts.
- Select the Class: Choose the correct trademark class from 45 categories based on your business activity.
- Application Filing (Form TM-A): Submit the application with the required documents and government fees.
- Examination by Trademark Office: The Registrar reviews the application and may raise objections if there are any issues.
- Publication in Trademark Journal: If no objection or opposition is raised, the mark is published in the journal for public viewing.
- Trademark Registration Certificate: If no oppositions arise, the Registrar issues the certificate of registration. The trademark is valid for 10 years and can be renewed indefinitely.
